This Privacy Policy explains how we process the personal data of website visitors, customers, sole traders and contact persons acting on behalf of our business partners.

2. Personal Data We Process

Depending on how you interact with us, we may process:

  • Your name, business name, company identification number and VAT identification number, where these constitute personal data.
  • Billing and delivery addresses.
  • Email address and telephone number.
  • Information about orders, payments, deliveries and complaints.
  • The contents of our correspondence.
  • Newsletter subscription information and records of consent or withdrawal of consent.
  • Technical data necessary to operate and secure the website, such as IP addresses and operational logs.

We obtain data primarily directly from you when you place an order, submit an enquiry, contact us or subscribe to our newsletter. We may also obtain the contact details of employees or company representatives from their employer or the company they represent.

3. Purposes and Legal Bases of Processing

Orders and contracts
We process the personal data of customers who are natural persons to take steps before entering into a contract and to perform that contract under Article 6(1)(b) GDPR. This includes processing orders, delivering goods and related communication.

Communication with company contact persons
We process the data of employees and representatives of business partners on the basis of our legitimate interests under Article 6(1)(f) GDPR. Our interests are maintaining business relationships and communicating with our business partners.

Accounting and legal obligations
We process data necessary for accounting, issuing and retaining documents, and complying with other legal obligations under Article 6(1)(c) GDPR.

Complaints and protection of legal rights
We process data as necessary to fulfil contractual and legal obligations and to establish, exercise or defend legal claims. Depending on the circumstances, the legal basis is the performance of a contract, compliance with a legal obligation or our legitimate interests.

Newsletters and promotional offers
If you subscribe, we process your email address on the basis of your consent under Article 6(1)(a) GDPR. Consent is voluntary and is not a condition of purchase. You can unsubscribe using the link in each marketing email or by contacting tcs@productive-tools.eu.

Website operation and security
We process necessary technical data on the basis of our legitimate interests in operating a secure and functional website.

Providing the data needed to process an order is a contractual requirement. Without the necessary information, we cannot fulfil your order. Providing other data is voluntary.

4. Data Retention

We retain personal data only for as long as necessary for the relevant purpose:

  • Order information and business correspondence are retained for the duration of the business relationship and generally for three years after the relevant contract has been fulfilled.
  • Accounting and tax documents are retained for the periods required by law. VAT documents are generally retained for ten years from the end of the relevant tax period.
  • Data relating to complaints and disputes are retained while the matter is being resolved and for as long as necessary to protect legal claims.
  • Newsletter data are retained until consent is withdrawn or the newsletter service ends. We may retain necessary records of consent and unsubscribing to demonstrate compliance with legal obligations.
  • Technical logs are retained for a period proportionate to operational and security needs.

Where a dispute is ongoing or the law requires a longer retention period, we retain the necessary data for the corresponding period. We then delete or anonymise the data.

5. Recipients of Personal Data

Where necessary, personal data may be shared with:

  • Webnode AG, the provider of our website and online store platform.
  • Carriers handling the relevant shipment, particularly the provider of the Balíkovna service or DHL.
  • ČSOB, for payment processing.
  • Accounting, IT and legal service providers, where we use their services.
  • Public authorities where disclosure is required by law.

Depending on the service provided, these recipients may act as data processors or independent controllers. We do not sell personal data.

If we introduce an external newsletter service, we will add information about its provider before that processing begins.

6. International Data Transfers

The Webnode platform is provided by Webnode AG, based in Switzerland. Using its services may involve processing personal data outside the Czech Republic.

Any transfer of personal data outside the European Economic Area must rely on an appropriate mechanism under the GDPR, such as a European Commission adequacy decision or Standard Contractual Clauses. Information about the relevant safeguards is available on request.

7. Cookies

The website uses technical cookies necessary for its basic operation, such as operating the shopping cart and remembering essential settings.

If introduced, analytics and advertising cookies will be used only after the appropriate consent has been obtained. Refusing these cookies does not prevent you from using the basic functions of the online store. You can change your preferences through the website's cookie settings.

We do not currently use Google Analytics. Details of the cookies actually used and their expiry periods are available in the website's cookie settings.

8. Your Rights

Subject to the conditions set out in the GDPR, you have the right to:

  • Access your personal data and obtain a copy.
  • Request correction of inaccurate data or completion of incomplete data.
  • Request erasure or restriction of processing.
  • Data portability where the legal conditions are met.
  • Object to processing based on legitimate interests.
  • Withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal.
  • Lodge a complaint with the Czech Office for Personal Data Protection, https://uoou.gov.cz/.

To exercise your rights, contact us at tcs@productive-tools.eu. Certain rights may be limited, for example by statutory obligations to retain accounting documents or the need to protect legal claims.

9. Security

We implement appropriate technical and organisational measures to protect personal data against unauthorised access, loss, misuse or disclosure. Access is limited to persons who need the data to perform their work.
